Seamless Context, Terms of Sale and Licence

These terms are between you ("you") and A.E. Hakes, D.B. Hakes and B.E. Hincapie (ABN 51 080 702 994) ("we", "us"). By buying or using Seamless Context you agree to them.

1. What you are buying.

A licence to use Seamless Context, a plugin for Codex that saves a bounded summary of a conversation before it is compacted and restores it afterwards. You are buying the right to use the software. You are not buying the software itself or its source code.

2. Price and payment.

The price shown at checkout (US$49, or the introductory price shown at the time) is a single payment in US dollars and includes GST where GST applies. There is no subscription and no recurring charge. Payment is processed by Stripe. We never see or store your card details.

3. Your licence.

When payment is confirmed we e-mail you and show on screen a licence key and a personal download link. The licence:

• is for you, for your own use, on up to 3 computers that you own or control;
• covers all updates in the 1.x version series;
• is non-exclusive and non-transferable, and lasts for the life of version 1.x, unless ended under these terms.

The 3-computer limit is based on trust. The software does not collect information about your computers to enforce it.

4. What you may not do.

Share your key or download link publicly or with people outside your own devices; resell, rent, or sublicense the software; remove the licence check; or copy it for others to use without their own licence. The software contains third-party components that stay under their own licences, listed in the package's legal folder.

5. Your key is personal.

Keep it private. If it is leaked we may revoke it and issue you a new one. You can ask for your key to be e-mailed again at any time using the "resend my key" page or by writing to the support address below.

6. Refunds.

See the Refund Policy. In short: a full refund within 30 days, no questions asked. A refunded licence is switched off (see section 4 of the Refund Policy).

7. Support.

E-mail support@actuallyintelligent-ai.com. We aim to reply within 3 business days. This is a target, not a guarantee.

8. Requirements and risk.

Seamless Context works with specific versions of the Codex app on Windows, listed on the product page and in the customer guide. We cannot promise it will work with future versions of Codex, which we do not control. If a Codex update stops it working, we will make reasonable efforts to release a fix within the 1.x series, or refund you if we cannot.
The software saves and restores notes about your conversations on your own computer. You are responsible for backing up anything important. Do not rely on it as the only copy of important information.

9. Your rights under law.

Nothing in these terms limits any right you have under the Australian Consumer Law or other law that cannot be excluded. Subject to that, our total liability to you for any claim about the software is limited to the price you paid, and we are not liable for indirect or consequential loss (such as lost profits or lost data), to the extent the law allows.

10. Ending the licence.

You can stop using the software at any time. We may end your licence, with notice where practical, if you seriously break these terms (for example by publicly sharing your key). If we end it for that reason we will not refund you. We will not end it for any other reason.

11. Changes.

We may update these terms for future sales. The terms you accepted when you bought continue to apply to your licence.

12. Governing law.

The laws of New South Wales, Australia, apply, and the courts of New South Wales have non-exclusive jurisdiction.
